To open a MyPay Communications account, one must possess an Indian mobile number and an email address. Every person who is 18+ can open an account. Minors can get access as well under the supervision of an adult. They can get access but are prohibited from making transactions regarding material that is for adult consumption.
Once your access to MyPay Communication is suspended, you cannot avail of further services from this platform. On account of fake details, the account will be immediately suspended. Apart from that, MyPay Communications is only accessible to people who are competent to contract under the Indian Contract Act, 1872. Minors accessing the account pretending to be majors will get their accounts terminated as soon as MyPay communications discover it. Once terminated, the person cannot create an account on MyPay communications.
The users agree that every detail demanded by MyPay Communications and provided by users is authentic. This includes the user’s private information, payment method, etc. User agrees that every piece of information shared by the user will be protected under MyPay Communication’s privacy policy and will be shared with government agencies as and when required. Since you are accessing this site, you are responsible for handling your username and password. In case of any misconduct happening based on the same, shall not be MyPay Communication’s liability or responsibility.
The User shall comply with the provisions contained in the Information Technology Act, 2000 and the statutory rules framed thereunder. MyPay Communications encourage users to go for a strong password. Make sure you don’t give access to your password to anyone concerning you. In case of any mishap, we cannot be held accountable. If you find anything unusual, change your password immediately. The user further agrees that it shall not engage in any activity that leads to a violation of the law.
MyPay Communications keep a close check on inactive accounts. In case the account stays inactive for 6 months continuously, the company will reclaim it without notifying the concerned user.
We do include a reference or third-party links for our users to go through and understand things better. But we are not responsible in the case of any falsely supplied information leading to consequences.
Be prepared for receiving transactional or non-transactional SMS or emails from us. We love to keep our users informed of frequent updates concerning them. MyPay Communications’ active channel ensures you receive every important notification. But in case you somehow don’t get an alert or notification, we are not liable for the same.
No person working at MyPay Communications (Director, Employees, Agents, etc.) will be liable for any sort of damages claimed by the users. These damages include direct, indirect, incidental, consequential, punitive, or exemplary damages.
This is said about the following:
If by chance, any court of law agrees to damaged done by the people working in the organization, MyPayCommunications is only liable to pay the amount contributed by the concerned user (not more than that). Users agree that MyPay Communications has offered its services, set charges, and entered into this agreement with reliance upon the warranty, disclaimers, and the limitations of liability set forth herein. Users acknowledge that the warranty, disclaimers, and the limitations of liability reflect a reasonable and fair allocation of risk.
If MyPay Communications is notified by the bank of conduct of a fraudulent transaction, the user will instantly be notified by MyPay Communications. The user needs to be prepared with all relevant documents concerning the transaction within a limit of 5 days or the specified period by the concerned bank. In case a user fails to submit the documents or the bank denies of the authenticity, then the bank is entitled to notify MyPay Communication to effect a reversal of the
debit of the chargeback amount immediately such that the said chargeback amount is credited to the Customer’s Payment Instrument. In case of pending inquiries and investigations, MyPay Communications is also entirely to suspend the settlement of the amount or hold the value of the transaction until cleared.
In case the amount associated with the Fraudulent Transaction has been settled in advance, any further action will be taken based on RBI’s notifications, circulars, and guidelines issued in this regard. Apart from that, the user agrees to pay all fines, penalties, and charges imposed by the Banks or any other regulatory authority on account of violating the concerned law.
The user further agrees that if the current balance in the account is not sufficient to meet up the imposed charges, MyPay Communication shall issue a debit note seeking reimbursement of the Chargeback Amount from the User. once MyPay Communication issues the debit note, users are required to clear the amount within 3 working days.
Both the conducting parties agree that any mandatory transaction arriving due to a lack of balance in the users’ account shall always be the liability and responsibility of the concerned user.
The User hereby acknowledges and agrees that MyPay Communications acts as a facilitator for the smooth processing of authorized transactions. MyPay Communications is not liable for any Chargeback Amount coming forward due to the conduct of any unauthorized transaction. The users are completely responsible for the protection of transactions conducted online or otherwise. MyPay communications will always be there to assist you with your queries or disputes regarding payment between users and customers. But MyPay Communications does not bear the responsibility of any sort for fraudulent transactions.
The user must keep confidential information confidential. He hereby agrees that the confidential information will only be used while the conduct of the concerned transaction. The user also agrees that he understands the importance of the secrecy of sensitive data including information regarding customers, transaction records, etc. It must be noted that none of the parties involved i.e. users or employees of the organization can violate this clause.
The user agreement shall be construed in accordance with the laws of India. In case of any disputes, the matter shall go to the courts of Udaipur.
User agrees and acknowledges to indemnify and save MyPay Communication, its employees, affiliates, agents, partners, licensors, officers, directors, and other third-party suppliers from any claims, demands, actions, suits arising against MyPay Communications.
The users also agree to protect the said parties from all losses, damages, and liabilities arising out of misuse of MyPay Communications services by the users (Platform/site/app).
The User agrees to cooperate with MyPay Communication’s defense and settlement of these claims. MyPay will use reasonable efforts to notify the User of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it.
This agreement is effective until terminated by any of the concerned parties, the User or MyPay Communications. The agreement can be terminated at any point in time when the user feels like disassociating himself from the platform. MyPay Communications reserves all rights to terminate this agreement at any given point without prior notice, thereby withdrawing your access to the site. Such termination of agreement occurs without any liability to MyPay Communications. Once terminated, you must get rid of all material posted on the platform.
In case the user is caught doing any of the following, MyPay Communications will immediately suspend the concerned account.
